FireWater Farms offers two membership tiers — each created to support a growing community of retriever enthusiasts and to help maintain and improve our farm, grounds, and events.
1. Acknowledgment of Risks:
I, the undersigned, acknowledge that participating in dog training, competitions, and other events at FireWater Farms involves inherent risks. These risks include, but are not limited to, interactions with dogs of various breeds, the natural behavior of wildlife, use of training and motorized equipment such as ATVs and UTVs, use of firearms, and natural hazards such as water bodies and uneven terrain. I understand these risks and voluntarily participate with full knowledge of the potential dangers.
2. Waiver of Liability and Hold Harmless Agreement:
I hereby release, waive, discharge, and agree to hold harmless FireWater Farms, its owners, agents, and employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, any animals in my care, or to any property belonging to me, while participating in activities or while on premises where the activities are conducted.
3. Third-Party Landowner Release:
I acknowledge that FireWater Farms events may take place on properties owned by third-party landowners who have voluntarily granted access for training, competitions, and other activities. I agree that these landowners, their agents, employees, and heirs shall not be held liable for any injury, loss, or damage, including but not limited to injury to myself, any animals in my care, or my property. I further agree to hold these landowners harmless from any claims arising out of my participation in events on their property.
4. Indemnification:
I agree to indemnify and hold harmless FireWater Farms from any loss, liability, damage, or costs that may incur due to my participation, or the participation of any animals in my care, in activities or presence on the farm premises.
5. Animal Health and Behavior Certification:
I certify that all animals brought onto FireWater Farms, whether owned by me or in my care, are current on vaccinations and free from any known illnesses. I understand that crowds may be present and agree that no aggressive animal behavior will be tolerated. All necessary measures to prevent such behaviors are my responsibility.
6. Personal Responsibility and Equipment Use:
I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which might occur to me, any animals in my care, or my property, including those resulting from the use of any motorized or training equipment and firearms. I hereby fully and forever release and discharge FireWater Farms from any and all claims directly or indirectly arising from our participation in farm activities.
7. Emergency Medical Treatment:
In case of an injury or illness to me or any animals in my care while on the premises, I consent to receive medical treatment deemed advisable. I agree to bear any costs incurred as a result of such treatment for myself or any animals in my care.
8. Environmental Responsibility:
I agree to remove all trash and used items from the property upon leaving, maintaining the cleanliness and safety of the environment for all visitors and animals.
9. Photographic Release:
I agree to grant FireWater Farms and its representatives the right to take photographs and videos of me, any animals in my care, and my property while on the farm. I authorize FireWater Farms to use such photographs and videos for lawful purposes, including but not limited to publicity, illustration, advertising, and web content.
10. Acknowledgment of Understanding:
I have read this waiver of liability, hold harmless, and indemnification agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
11. Agreement Duration and Reaffirmation:
This agreement is ongoing and will apply to all future visits to FireWater Farms, regardless of the purpose of the visit. It also applies to all animals brought onto the property and in my care. I understand that it is my responsibility to update FireWater Farms if any of my information or circumstances change that may affect the terms of this waiver.
